Welcome to Petrichor Pages. These Terms and Conditions (“Terms”) govern your access to and use of the Petrichor Pages website, software, applications, formatting tools, digital products, and related services (collectively, the “Service”).
By accessing or using Petrichor Pages, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.
1. About Petrichor Pages
Petrichor Pages is a digital book-formatting service designed to help authors format manuscripts for publication and create professionally styled book interiors.
Petrichor Pages may provide tools for formatting, styling, customization, exporting, and preparing digital files for use with publishing platforms and/or print-on-demand services.
Petrichor Pages does not act as your publisher, literary agent, distributor, or legal representative.
2. Eligibility
You must be at least 18 years old, or have the permission and supervision of a parent or legal guardian, to purchase or use paid services through Petrichor Pages.
By using the Service, you represent that you have the legal authority to enter into these Terms.
3. Accounts
Certain features may require you to create an account.
You are responsible for:
- Providing accurate information;
- Maintaining the security of your account credentials;
- Keeping your account information current;
- All activity occurring under your account; and
- Not sharing your account credentials with unauthorized individuals.
You agree to notify Petrichor Pages promptly if you believe your account has been accessed without authorization.
Petrichor Pages reserves the right to suspend or terminate accounts that violate these Terms.
4. Purchases and Payments
Certain features, plans, themes, upgrades, or other digital products may require payment.
Prices are displayed at the time of purchase and may change in the future. A change in price will not retroactively alter a purchase that has already been completed.
You authorize Petrichor Pages and its payment processor to charge your selected payment method for applicable purchases.
Unless otherwise stated at the time of purchase, purchases are one-time payments and do not automatically renew.
5. Lifetime Access
Certain Petrichor Pages products may be advertised as providing “Lifetime Access.”
For purposes of these Terms, “Lifetime Access” means access to the applicable Petrichor Pages product for as long as Petrichor Pages continues to operate and is reasonably able to support and provide that product.
Lifetime Access does not mean guaranteed access for the literal lifetime of the purchaser, nor does it guarantee that the Service will remain available indefinitely.
Petrichor Pages may discontinue, substantially modify, replace, or retire a product or Service when reasonably necessary, including due to business circumstances, technological limitations, third-party services, security concerns, legal requirements, or circumstances beyond our reasonable control.
Where reasonably practicable, Petrichor Pages will provide advance notice of a planned discontinuation of a Service and may, at its discretion, provide an alternative product, replacement service, continued access for a limited period, or another reasonable accommodation.
Unless expressly stated otherwise at the time of purchase, Lifetime Access does not include:
- Future products that are sold separately;
- New premium themes or content released after your purchase;
- Third-party services or platforms;
- Technical support beyond the support provided by Petrichor Pages;
- Guaranteed compatibility with future operating systems, browsers, devices, publishing platforms, or file formats; or
- A guarantee that every feature will remain unchanged indefinitely.
Petrichor Pages does not guarantee uninterrupted or permanent availability of the Service.
6. Your Content
You retain ownership of manuscripts, text, images, illustrations, photographs, and other materials that you upload to Petrichor Pages (“User Content”), subject to any rights belonging to third parties.
By uploading User Content, you represent that you have the necessary rights, permissions, and licenses to use that content and to process it through the Service.
You grant Petrichor Pages a limited, non-exclusive, worldwide, royalty-free license to host, process, reproduce, transmit, and otherwise use your User Content solely as reasonably necessary to provide, maintain, secure, troubleshoot, and improve the Service.
Petrichor Pages does not acquire ownership of your manuscript or other User Content merely because you use the Service.
Petrichor Pages will not sell your manuscript or intentionally use your manuscript as a commercial product.
7. Responsibility for User Content
You are solely responsible for the content you upload, format, export, or otherwise process through Petrichor Pages.
You may not use the Service to upload or distribute content that:
- You do not have the legal right to use;
- Infringes another person’s intellectual property rights;
- Violates applicable laws or regulations;
- Contains malicious software or code;
- Is intended to harm, deceive, or exploit others; or
- Violates these Terms.
Petrichor Pages reserves the right to remove content or restrict access where reasonably necessary to protect the Service, its users, or third parties.
8. Your Finished Books and Exports
You retain ownership of the books, manuscripts, and other original creative works you create using Petrichor Pages.
Subject to your rights in the underlying content, you may use, publish, distribute, sell, print, and otherwise commercially exploit files you create or export through the Service.
Petrichor Pages does not claim ownership of your finished book merely because it was formatted using Petrichor Pages.
You are responsible for reviewing exported files before publication or commercial distribution.
Petrichor Pages does not guarantee that an exported file will be accepted by every publisher, printer, ebook retailer, print-on-demand platform, or other third-party service.
9. Themes, Artwork, Fonts, and Design Elements
Petrichor Pages may provide themes, decorative elements, artwork, layouts, fonts, templates, or other design assets (“Petrichor Assets”).
Unless expressly stated otherwise, Petrichor Assets are licensed to you for use within books and other projects created using Petrichor Pages and are not sold to you as standalone intellectual property.
You may not:
- Resell Petrichor Assets as standalone files;
- Redistribute or sublicense Petrichor Assets;
- Claim ownership of Petrichor Assets;
- Extract Petrichor Assets for use as a competing asset library; or
- Use Petrichor Assets to create a competing formatting or design service.
Your license to use Petrichor Assets may be subject to additional licensing restrictions disclosed with particular assets.
10. Intellectual Property
Petrichor Pages and its licensors retain all rights, title, and interest in the Service, including its software, code, user interface, branding, logos, templates, themes, graphics, documentation, and other proprietary materials, except for User Content.
The name “Petrichor Pages,” associated logos, branding, and other identifying materials may not be used without prior written permission.
These Terms do not grant you ownership of the Petrichor Pages software or underlying technology.
11. Acceptable Use
You agree not to:
- Copy, reproduce, or redistribute the Petrichor Pages software;
- Reverse engineer, decompile, or attempt to extract source code from the Service except where expressly permitted by applicable law;
- Circumvent security features or access restrictions;
- Attempt to gain unauthorized access to another user’s account;
- Use automated systems to abuse, overload, or interfere with the Service;
- Resell access to your account;
- Create a competing service using Petrichor Pages software, proprietary designs, or protected assets;
- Remove proprietary notices or branding where prohibited; or
- Use the Service for unlawful purposes.
12. Third-Party Services
Petrichor Pages may rely on third-party services for hosting, payment processing, authentication, analytics, file storage, email delivery, publishing integrations, or other functionality.
Petrichor Pages is not responsible for outages, changes, errors, security incidents, or discontinuation of third-party services outside of its reasonable control.
Your use of third-party services may also be subject to the third party’s own terms and privacy policies.
13. Service Availability and Changes
We strive to keep Petrichor Pages available and functioning properly, but we do not guarantee uninterrupted, error-free, or continuous availability.
The Service may occasionally be unavailable because of:
- Maintenance;
- Updates;
- Security issues;
- Technical failures;
- Internet or hosting disruptions;
- Third-party service interruptions;
- Changes in technology;
- Legal or regulatory requirements; or
- Events beyond our reasonable control.
Petrichor Pages may add, remove, modify, or discontinue features at any time.
14. Formatting Accuracy
Petrichor Pages is a formatting tool and is not a substitute for reviewing your book before publication.
You are responsible for reviewing your final files for:
- Spelling and grammatical errors;
- Missing or duplicated text;
- Page breaks;
- Chapter formatting;
- Margins and trim dimensions;
- Images;
- Fonts;
- Headers and footers;
- Table of contents accuracy;
- Printing issues; and
- Compatibility with the platform or printer where the book will be published.
Petrichor Pages does not guarantee that files will be completely free of formatting errors.
You are responsible for saving your manuscripts. Petrichor Pages does not provide document storage.
15. Refunds and Cancellations
Refund eligibility is governed by the Petrichor Pages Refund Policy, which is incorporated into these Terms by reference.
Because Petrichor Pages may provide digital products and software access immediately following purchase, certain purchases may not be eligible for refunds once access has been provided, except where required by applicable law or expressly provided in the Refund Policy.
16. Privacy
Your use of Petrichor Pages is also governed by the Petrichor Pages Privacy Policy.
The Privacy Policy explains what information we collect, how it is used, and how it may be stored and processed.
17. Disclaimer of Warranties
To the maximum extent permitted by applicable law, Petrichor Pages is provided on an “as is” and “as available” basis.
Petrichor Pages makes no warranties, express or implied, regarding:
- Continuous availability;
- Error-free operation;
- Compatibility with every device, browser, operating system, printer, publisher, or publishing platform;
- The accuracy or completeness of formatting results;
- The acceptance of exported files by third-party platforms; or
- Any particular commercial result from using the Service.
Nothing in these Terms excludes warranties or rights that cannot legally be excluded under applicable law.
18. Limitation of Liability
To the maximum extent permitted by applicable law, Petrichor Pages and its owners, employees, contractors, affiliates, licensors, and service providers will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to your use of the Service.
This includes, without limitation, loss of profits, loss of business opportunities, loss of data, publication delays, printing costs, or lost revenue.
To the maximum extent permitted by law, Petrichor Pages’ total liability arising from your use of the Service will not exceed the amount you paid to Petrichor Pages for the applicable Service during the twelve months preceding the event giving rise to the claim.
Nothing in these Terms limits liability that cannot legally be limited under applicable law.
19. Indemnification
You agree to defend, indemnify, and hold harmless Petrichor Pages and its owners, employees, contractors, affiliates, licensors, and service providers from claims, damages, liabilities, losses, and expenses arising from:
- Your violation of these Terms;
- Your User Content;
- Your violation of another person’s rights;
- Your unlawful use of the Service; or
- Your violation of applicable laws or regulations.
20. Suspension and Termination
Petrichor Pages may suspend or terminate your access to the Service if you materially violate these Terms, engage in fraudulent or abusive activity, create a security risk, or otherwise misuse the Service.
Where appropriate and reasonably practicable, Petrichor Pages may provide notice and an opportunity to correct the violation before terminating access.
Termination does not affect provisions that by their nature should survive termination, including intellectual property rights, disclaimers, limitations of liability, indemnification, and dispute-related provisions.
21. Changes to These Terms
Petrichor Pages may update these Terms from time to time.
When material changes are made, we may provide notice through the website, email, or another reasonable method.
Your continued use of the Service after the effective date of updated Terms constitutes acceptance of the updated Terms.
22. Governing Law
These Terms will be governed by the laws of the State of Arizona without regard to its conflict-of-law principles, except where applicable law requires otherwise.
Any dispute arising from these Terms or your use of Petrichor Pages will be handled in the courts located in Arizona, unless otherwise required by applicable law.
23. Severability
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
24. Entire Agreement
These Terms, together with the Privacy Policy, Refund Policy, and any other policies expressly incorporated by reference, constitute the entire agreement between you and Petrichor Pages regarding your use of the Service.
